“Opt-out” organ procurement policies based on presumed consent are typically advertised as being superior to “opt-in” policies based on explicit consent at securing organs for transplantation. However, Michael Gill has argued that presumed consent policies are also better than opt-in policies at respecting patient autonomy. According to Gill’s Fewer Mistakes Argument, we ought to implement the procurement policy that results in the fewest frustrated wishes regarding organ donation. Given that the majority of Americans wish to donate their organs, it is (...) plausible that a presumed consent policy would result in fewer frustrated wishes compared to the current opt-in policy. It follows that we ought to implement a policy of presumed consent. In this paper, I first consider and find wanting an objection to the Fewer Mistakes Argument developed recently by Douglas MacKay. I also consider an objection put forth by James Taylor but argue that there is a methodological reason to prefer my own argument to Taylor’s. Finally, I argue for two theses: first, that Gill’s major argument in favor of the crucial premise of the Fewer Mistakes Argument is flawed, and second, that the major premise of the Fewer Mistakes Argument is false. Democracy establishes relationships of political equality, ones in which citizens equally share authority over what they do together and respect one another as equals. This article introduces and discusses a series of problems which any adequate account of legitimate practical authority must be able to solve. I then argue that Joseph Raz's influential Service Conception of Authority is unable to solve them. I develop a new account of legitimate authority by integrating many of the important insights of the Service Conception into my own framework for understanding the nature of moral rights and duties. John McDermott, Streams of Experience I investigate one manner in which classical American pragmatism might be utilized by theorists and practitioners interested in addressing urban environmental problems. Despite the widespread adoption of the sustainability moniker within the environmental movement, (...) evidence suggests that progress toward implementing urban environmental sustain ability proposals has been minimal. To address this inaction, I undertake an analysis of the philosophy of progress guiding efforts to transition urban environments toward sustainability. I argue that one of the reasons so little has been accomplished in terms of implementing existing urban environmental sustainability proposals is that a disproportionate emphasis has been placed on values that stem from economic-centered indicators of progress. I argue that the value of progress ought to be less about how much of a certain type of economic growth sustainability proposals ultimately can generate for urban environments and more about ensuring that continual incremental societal progress takes place. BackgroundThe evolution of the female orgasm in humans and its role in romantic relationships is poorly understood. Whereas the male orgasm is inherently linked to reproduction, the female orgasm is not linked to obvious reproductive or survival benefits. It also occurs less consistently during penetrative sex than does the male orgasm. While individuals and movements openly advocating “Buddhist socialism” only begin to appear in Japan in the first decade of the twentieth century, germs of the idea can be traced back to the writings of a few scholars and social activists of the 1880s. One example of the latter is the Eastern Socialist Party, founded by TARUI Tōkichi 樽井藤吉 in 1882. Though the party was short-lived – setting a dubious precedent for left-wing parties over the next 50 years in being forcibly (...) suppressed by the government within months of its inception – the writings of Tarui and other founding members were, for their day, quite radical, and provide an early example of the tension involved in attempting to transform the world – “make it new!” to use the modernist catchphrase – while remaining true to one’s cultural roots. The “draft of the party’s regulations”, written by Tarui, contains 17 articles, along with a number of sub-clauses. Here, we see several of the tensions that would haunt Japanese experiments in progressive and radical Buddhism over the next several decades. First is the natural but difficult attempt to “indigenize” socialism by appealing to traditional Asian concepts and ideas; second is the appeal to the East Asian values of peace and harmony, which was frequently accompanied, among early socialists, with an appeal to the Emperor as benevolent protector of the social welfare of the Japanese people. This essay will explore socialist movements and their connection to Buddhist ideas in modern Japan. (shrink)
